Are any attorneys exempt from CLE in Arizona?

Yes. Arizona exempts some lawyers from MCLE under Supreme Court Rule 45.

Exempt or deemed-compliant categories include inactive and retired members, certain court personnel who meet COJET requirements, retired judges subject to assignment, lawyers who turned 70 before January 1, 2009, newly admitted lawyers (full exemption if admitted Jan 1–Jun 30; two-thirds of the annual hours if admitted Jul 1–Dec 31), active members residing in and complying with another MCLE jurisdiction, and members granted a one-year hardship exemption or deadline extension.

Who is exempt or deemed compliant

  • Inactive and retired members: Exempt for the educational year; transfer year is also exempt.
  • Court personnel subject to COJET: Court administrators, clerks, and similar personnel are deemed compliant by filing a COJET affidavit.
  • Retired judges subject to assignment: Deemed compliant when Rule 45 conditions are met.
  • Age grandfathering: Active members who reached age 70 before January 1, 2009 are exempt.
  • New admittees: Admitted Jan 1–Jun 30 → no MCLE for that educational year; admitted Jul 1–Dec 31 → complete two-thirds of the annual requirement.
  • Out-of-state compliance: Active member resides in another MCLE jurisdiction and fully complies there.
  • Hardship: One-year exemption or extension may be granted by the State Bar CEO or designee upon application and showing of undue hardship.

Timing and filing context

  • Educational year: July 1 to June 30.
  • Affidavit: Due by September 15 for active, non-exempt members.

Key Takeaway: In Arizona, exemptions cover inactive or retired status, qualifying court personnel and retired judges, certain new admittees, out-of-state compliant members, and documented hardship, with specific conditions set by Rule 45.
