What are the CLE requirements for inactive attorneys in Indiana?

An attorney who files an affidavit of inactivity in Indiana is exempt from the CLE (MCLE) educational and reporting requirements under Rule 29.

That exemption continues while the attorney remains in inactive status and is registered as such.

Details:

  • Rule 29(c) provides that an attorney who files an affidavit of inactivity or retirement is exempt from CLE obligations.
  • If an inactive attorney seeks to return to active status and has been inactive for less than one year, the attorney must complete any remaining CLE obligations earned up to the date of inactive status.
  • Upon reactivation after a longer inactivity period, the attorney must comply with CLE requirements applicable to active attorneys under Rule 29.
  • The Rule’s general CLE obligations for active attorneys are 6 hours per year and 36 hours per three-year educational period (including at least 3 hours of professional responsibility).

Key Takeaway:
In Indiana, inactive status grants a full exemption from CLE obligations; when returning to active status, attorneys must complete any remaining or new CLE requirements to restore compliance.
