What are the CLE requirements for inactive attorneys in Kansas?

An attorney registered as inactive in Kansas is exempt from the CLE requirement under Rule 800(d)(2).

If the attorney later changes status to active, they must comply with the CLE requirement under Rule 804(a) by the end of the compliance period in which status changes.

Details:

  • Rule 804(a) requires active attorneys in Kansas to complete 12 hours of CLE per compliance period, at least 2 of which must be in ethics and professionalism.
  • Rule 800(d)(2) explicitly exempts attorneys registered under Rule 206 as inactive, retired, or disabled from the CLE requirement.
  • Rule 811 governs an inactive attorney returning to active status: upon status change, the attorney must meet the CLE requirement under Rule 804(a) during that compliance period.
  • Changing to inactive status mid-year does not relieve the attorney of the CLE requirement for that year if already active.

Key Takeaway:
In Kansas, inactive attorneys owe no CLE while inactive, but once they convert to active status they must complete 12 CLE hours (including 2 ethics) before the end of that compliance period.
